ISLE OF WIGHT, Va. (WAVY) -- Virginia State Police (VSP) say a woman died Sunday as a result of injuries she sustained during a crash earlier this week.

Police say 68-year-old Nancy Bradshaw Hearn was transported to a local hospital with life-threatening injuries following a two-vehicle crash in Smithfield on Feb. 22.

The investigation determined the driver of a Honda Odyssey slowed down to turn into a gas station when his vehicle was struck from behind.

Hearn, the front-seat passenger in the Odyssey, suffered life-threatening injuries as a result of the impact, according to State Police.

The 17-year-old male driving the other vehicle was charged with unsafe speed for roadway conditions.

Everyone involved was wearing a seat belt, police said.

HAMPTON, Va. (WAVY) — It was a sight you wouldn't expect to see except on Black Friday.

Hours before the doors opened at the Bass Pro Shop in Hampton, customers wrapped around the building hoping to get a chance to buy ammunition.

"I'm a gun enthusiast and a Marine, and I love shooting, so I'm here to get some ammo," said Alvin Mccloud, a Newport News resident waiting in line.

Chris Kepics and his chihuahua Coco were first in line around 7 a.m. and the first with bags in tow.

"I am the proud owner of 500 rounds of 9 mm. I got a really good price on this considering how much ammo is nowadays," Kepics said.

Shortly after the store opened, customers came out saying they were sold out.

Kepics says ammo is nearly impossible to find anywhere in the country right now. He says ever since last summer, all of the more "common types" of ammunition, like 9 mm, is incredibly scarce.

If and when it can be found, he says retailers tend to mark the price up to five or 10 times what it was pre-pandemic.

However, he says, places like the Bass Pro Shop still have reasonable prices -- thus, all the people.

"9 mm can be anywhere from 89 cents to a dollar per bullet, but if you do the math on this one, I think it's like 30 some cents around," explained Kepics.

One local says it was a combination of things that sparked this spike.

"Sort of a perfect storm of a bunch of different factors. You have the supply interruption, then you have the increase in demand from social unrest," said Newport News resident, Joe Hemphill.

Management at the store says they get this line every time they get a big stock back in and have many repeat customers.

Let us say good riddance to February, a month that boasted over six inches of rain and turned our backyards into mud pits. In fact, it ranks as the 4th wettest February on record! So as we try to welcome in March (also Meteorological Spring), Mother Nature won't make it so easy. More rain gets thrown back into the forecast as an approaching cold front will switch things up. I wouldn't say March comes in like a lion, but definitely makes things interesting.

A weird, spring-like, warm night is upon us as February gets thrown in the rearview mirror. A southwest breeze tonight not only holds temperatures near 60, but pumps in more moisture. A stray shower can't be ruled out overnight, but most rain arrives with the approaching front Monday morning. It'll be a cloudy, balmy, a touch breezy start the Monday; temperatures should be in the low 60s still.

Pockets of rain slide in by mid-morning or so, likely on and off through the early afternoon before tapering off by dinner time.

The breeze should be out of the southwest for the majority of the day, but by midday, it'll flip out of the north. Bang - in comes the colder air. We should finish the day with temperatures that feel nearly 20° cooler than when the day started - 60s fall quickly to the 40s.

Things likely clear out Monday night as the cooler and dry air drops in. That does mean plenty of sunshine by Tuesday, but highs will be in the low 40s, about 10° below average. Some moisture then slides up from the south on Wednesday, sure it throws a couple showers our way but should bring temperatures back into the 50s. Things look pretty quiet by the end of the week and next weekend.

RICHMOND, Va. (WRIC) -- The Virginia Commonwealth University chapter of Delta Chi has been suspended following the death of an 18-year-old freshman.

Adam Oakes, 18, of Loudoun County, died in an incident linked to the fraternity. VCU tweeted a statement on Sunday confirming Oake's death.

"VCU mourns the death of student Adam Oakes who was identified by authorities at an off-campus residence early Saturday," the university said in its statement.

The college said the national office for Delta Chi issued a cease-and-desist order on Saturday, and VCU said it took "similar action" today.

The university added the Richmond Police Department is leading the investigation of this incident and VCU Police Department is assisting.

Michael Roa, president of VCU, tweeted that the college will work closely with local law enforcement on this investigation.

"We are heartbroken at the tragic loss of one of our own," he said in the tweet. "I offer my heartfelt sympathies to Adam’s loved ones and closest friends."

We were devastated to learn of the passing of a student at Virginia Commonwealth University and extend our condolences to the family, friends and everyone touched by this heart-breaking news. The health and safety of our chapter communities is always a top priority for The Delta Chi Fraternity, which suspended the VCU chapter after learning of the incident late Saturday afternoon. We encourage all members to cooperate with law enforcement investigative efforts and all directives of the University Administration.

The cause of death has not been released by officials but the family is adamant it was a result of incidents within the fraternity.

Oakes' family said they found he had died through the Loudon County Police department, but they found out how he died through social media.

"Everyone in this family, we're all devastated. We don't -- he's all we had, everything we had in life," said Eric Oakes, Adam's father. He began to tear up as he talked. "He's a lovely kid, he just totally enjoyed life."

"He was sweet, he was so sweet," said Courtney White, Adam's cousin. "He had the biggest heart he would literally give you the shirt off his back."

As of Sunday, the fraternity has deactivated its Twitter, Facebook and Instagram accounts.

There is currently a gofundme for Oakes' funeral costs. It exceeded the goal of $15,000 in under 24 hours.

PORTSMOUTH, Va. (WAVY) — The Virginia Department of Health is reporting 1,736 new coronavirus cases along with 170 new deaths. The percent positivity rate in the state is down to 7.2%.

As of Sunday morning, February 28, Virginia has an overall number of 576,050 coronavirus cases since the start of the outbreak. Of the overall cases reported, 453,932 have been confirmed by testing. 122,118 are probable cases, in which a patient who shows symptoms is diagnosed without testing.

Statewide numbers

• New cases: (+1,736, 576,050 total)
• New deaths (+134, 7,331 total) trending up
• Current hospitalizations (+24, 1,323 total)
• Testing (7.2% 7-day average of positive tests), trending down for more than a month, testing down (about 23 per day on average)
• Doses administered (1,933,953 total doses, 34,744 per day on average, 666,970 fully vaccinated, 14.8% with at least one dose)
• Doses distributed (2,361,445 total), 92.4% first doses administered and 64.3% second doses administered

The Virginia Department of Health has found the first case of the COVID-19 variant from the United Kingdom in the southwest region of Virginia.

The variant was identified in samples from three adult residents in Southwest Virginia who had no history of travel during their exposure periods.

VDH says they’ve investigated all three cases and their close contacts and managed them appropriately.

As of Friday, the VDH says the Commonwealth has a total of 20 cases of the UK variant (B.1.1.7) and three cases of the South Africa variant (B.1.351).

Virginia Department of Health (VDH) announced Saturday that the new, Johnson & Johnson single-dose COVID-19 vaccine will begin being offered in the state next week.

The news comes just hours after the federal approval of the third vaccination, which, officials say, has been proven to prevent serious illness, hospitalization, and death from the disease.

On Saturday, the U.S. Food and Drug Administration (FDA) issued an emergency use authorization (EUA) for a new vaccine made by Johnson & Johnson. The EUA allows the vaccine to be distributed in the U.S. for those 18 and older.

According to the Virginia Hospital and Healthcare Association, 1,323 residents in Virginia are currently hospitalized due to the virus. That number is a combination of confirmed positive COVID-19 patients and hospitalized patients whose COVID-19 test results are still pending.

HAMPTON, Va. (WAVY) — Police say a 29-year-old man was pronounced dead following a shooting in Hampton Sunday morning.

Hampton Police say they are currently investigating the homicide that occurred in the 2100 block of Newton Road. The call for the incident came just before 8:30 a.m. Sunday.

The victim, a still-unidentified man, was prounounced dead from gunshot injuries.

There is no further information at this time.

RICHMOND, Va. (WRIC) – The Virginia General Assembly voted to pass legislation Saturday that calls for the legalization of recreational marijuana use and retail sales to begin in 2024, but one key Democrat stressed that the approved bill was just a step in a long process.

The Virginia Senate and House of Delegates, both under Democratic-controlled, adopted conference reports after hours of debate and private discussion over the legislation.

Even without full support from Democrats, the Virginia House voted 47-44 to approve the compromise and legalize marijuana in 2024. One state delegates abstained. The Virginia Senate narrowly approved the measure, 20-19, with state Sen. Chap Peterson (D-Fairfax) voting against it.

Under the agreement reached by negotiators in the Virginia Senate and House, simple possession would still come with a $25 civil penalty for a first offense until retail sales begin on Jan. 1, 2024, and another vote in the General Assembly next year will determine several other components.

Lawmakers who spoke before the vote took time to address the fact that the bill would take years to go into effect, requires more state-funded reports and a new legislature would eventually vote on several key regulatory details.

State Sen. Richard H. Stuart (R-Stafford) questioned how the average Virginian would be able to understand the different aspects of the 264-page compromise report when those in the chamber couldn't go over each detail. He made it clear that people wouldn't be able to grow it in their back yard and can't have a certain amount until after several other steps over years.

Democrats conceded it was just a first step in the process, with even skeptical lawmakers deciding to vote for the bill.

"We need to make it clear, this bill is not legalization," state Sen. Jennifer McClellan (D-Richmond), a gubernatorial contender said. "There are a lot of steps for legalization.

Advocacy groups that support legalization said before the vote that the compromise failed to address social and racial justice concerns that initially drove the effort and called on legislators to reject the bill.

A re-enactment clause in the compromise report, one of the main sticking points in the negotiations, will require the state legislature to vote again next year on specifics surrounding the regulatory structure for legal sales and remaining criminal justice components of the bill. 

Groups that back legalization shared concerns over the penalty for simple possession remaining in place and an open container clause in the legislation, arguing that racial disparities in enforcement, even with decriminalization, still exist.

Justice Forward Virginia, Marijuana Justice, ACLU Virginia and RISE for Youth voiced their displeasure with the compromise after details were reported, calling it "worse than the status quo."

"This bill does not advance the cause of equal justice or racial justice in Virginia. It is the product of a closed-door legislative process that has prioritized the interests of recreational marijuana smokers over people and communities of color," the groups said in a joint statement. "The bill is a failure and we urge lawmakers to vote against it."

Sen. McClellan echoed that sentiment on the Senate floor on Saturday, questioning the chamber's ability to fully comprehend and vote on a 264-page compromise report and raising concerns concerning the disproportionate fines that Black Virginians still face with decriminalization. The question compelled the bill's patron and one of the conferees in the conference committee, state Sen. Adam Ebbin (D-Alexandria), to ask for the debate to go by momentarily.

After a recess and a long debate, the chamber followed the House and approved the conference report.

The compromise also calls for a possible misdemeanor charge, with a $250 fine, for anyone found guilty of driving with a partially open container of marijuana or marijuana product along with "the appearance, conduct, speech, or other physical characteristic," except for odor, of marijuana consumption.

Another difference, a non-binding referendum where Virginians would share whether they support legalization, did not make the final agreement, one person familiar with the agreement told 8News.

If the new General Assembly, which is expected to be different with all 100 House seats up for grabs, rejects the measure, simple possession would still be legal but retail sales would not. 

Legalization was presented as a major agenda item for Northam and Virginia Democrats before this year’s session. The Virginia Senate and House of Delegates, both under Democratic control, each passed legislation on Feb. 5 to legalize use and possession for those 21 years and older.

While the bills had similarities, including an automatic expungement process for misdemeanor convictions and establishing the Virginia Cannabis Control Authority by July to oversee the legal industry, legislators were expecting that a conference committee negotiation would be needed to work out the final details. 

With the special session ending Monday, lawmakers had until Saturday to finish their work on the legislation. The bill now goes to Northam, who was actively involved and "personally working closely" with lawmakers to get the bill passed this year, according to his spokesperson.

"Passing legislation this year ensures that the new Cannabis Control Authority and the Cannabis Equity Reinvestment Board can get up and running in 2021. The CCA will be responsible for writing regulations immediately and issuing licenses in future years," Alena Yarmosky, Northam's spokeswoman, told 8News in an email Saturday. "The Reinvestment Board will be made up of community leaders and will ensure that the state keeps social equity front and center in future years. These two organizations will provide much needed expertise and leadership in 2021 and the future, as legislators and others continue to refine details of what legalization will look like."

Democrats said they hoped Northam would add amendments, including one to repeal the penalty for simple possession in July, as the Senate's version had before the conference committee.

The Virginia NAACP initially denounced the agreement, saying it would only exacerbate criminal justice issues that prompted the calls for legalization before the legislative session. But issued a second statement applauding the effort to remove certain concerning aspects of the compromise.

“We are grateful that legislators successfully removed the most concerning aspects of the proposed legislation," Robert N. Barnette Jr., the president of the Virginia NAACP, said in a statement. "While the final conference report is not perfect, it's a step in the right direction and we hope legislators will move forward with its passage."

The compromise also includes an opt-out clause for localities to decide whether or not to allow retail sales through a referendum that must be certified by Dec. 31, 2022.

WASHINGTON (AP/WAVY) — The U.S. is getting a third vaccine to prevent COVID-19, as the Food and Drug Administration on Saturday cleared a Johnson & Johnson shot that works with just one dose instead of two.

Health experts are anxiously awaiting a one-and-done option to help speed vaccinations, as they race against a virus that already has killed more than 510,000 people in the U.S. and is mutating in increasingly worrisome ways.

The FDA said J&J’s vaccine offers strong protection against what matters most: serious illness, hospitalizations and death.

One dose was 85% protective against the most severe COVID-19 illness, in a massive study that spanned three continents — protection that remained strong even in countries such as South Africa, where the variants of most concern are spreading.

“The more vaccines that have high efficacy that we can get into play, the better,” Dr. Anthony Fauci, the top U.S. infectious disease expert, said ahead of the FDA’s ruling.

Shipments of a few million doses to be divided among states could begin as early as Monday. By the end of March, J&J has said it expects to deliver 20 million doses to the U.S., and 100 million by summer.

Virginia is on the list to receive shipments as early as next week.

"Good news — a third shot of hope in our fight against COVID-19. Virginia expects to receive approximately 69,000 doses of the Johnson & Johnson vaccine next week," Governor Ralph Northam tweeted Saturday.

J&J also is seeking authorization for emergency use of its vaccine in Europe and from the World Health Organization. Worldwide, the company aims to produce about 1 billion doses globally by the end of the year. On Thursday, the island nation of Bahrain became the first to clear its use.
